北院：重要證人已詰問 柯文哲、應曉薇具保停押
審理京華城案的台灣台北地方法院5日裁定前台北市長柯文哲以新台幣7000萬元、國民黨台北巿議員應曉薇以3000萬元交保，科技監控，均限制住居、限制出境出海，不得接觸被告、證人。圖為台北地院法警室收受案件告示。中央社記者吳家昇攝 114年9月5日 Newtalk新聞 （中央社記者劉世怡台北5日電）北院今天說，京華城案重要證人已交互詰問，被告柯文哲及應曉薇串證可能大幅降低，裁定各新台幣7000萬元、3000萬元交保，不得接觸本案被告、證人，須電子腳鐶、個案手機監控。 對此，台北地檢署指出，俟收到裁定理由後研議是否抗告。 台北地方法院發言人黃柄縉表示，柯文哲須以自己名義提出7000萬元保證金，應曉薇以自己名義提出3000萬元保證金後，均准予停止羈押，並限制住居於居所地，並至停止羈押起，限制出境出海8個月。 黃柄縉說，柯文哲、應曉薇應遵守事項，包含第1不得與同案被告、證人有任何接觸、騷擾、恐嚇或探詢案情的行為，第2須接受在左腳戴電子腳鐶，以及使用個案手機。 黃柄縉提及，合議庭審酌本案密集開庭進行證人交互詰問程序，目前與柯文哲、應曉薇涉犯貪污治罪條例的重要證人均詰問完畢，柯文哲、應曉薇滅證串供的機會已經大幅降低了。 至於檢察官主張尚有其他證人須進行詰問程序，認為2人仍有繼續羈押必要部分，黃柄縉表示，合議庭認為不得僅以其他證人尚未到庭，進行交互詰問及認為有串證之虞，否則將有為憲法保障被告的對質詰問權不符合比例原則。 台北地院發布新聞稿指出，就證人許芷瑜未到案部分，合議庭審酌她參與處理財務情節，有相關證人證述及對話紀錄在卷，且已經由檢察官通緝中，能否緝獲尚未可知，以證人許芷瑜未到案即認尚有羈押被告2人必要性，明顯不符合比例原則。 黃柄縉指出，斟酌柯文哲、應曉薇的犯罪情節、地位、職業身體狀況、資歷及訴訟進行的程度等情況，認為柯文哲、應曉薇向北院提出7000萬元及3000萬元的保證金之後，並輔以限制住居、出境、出海及科技設備監控等適當且必要的保全方法，可確保本案後續審判及執行程序進行，而無繼續羈押必要。可抗告。 台北地檢署偵辦京華城案、柯文哲政治獻金案，去年底依貪污治罪條例違背職務收受賄賂、圖利、公益侵占與背信等罪嫌起訴前台北市長柯文哲、威京集團主席沈慶京、國民黨台北市議員應曉薇、前台北市長辦公室主任李文宗等11人，具體求處柯文哲總計28年6月徒刑。 柯文哲、應曉薇所涉之罪為最輕本刑5年以上有期徒刑的重罪以及有勾串可能等，於今年1月2日起執行羈押禁見，並先後自4月2日、6月2日、8月2日起分別延長羈押禁見2個月，這次羈押期限為10月1日期滿。 北院表示，因詰問證人彭正聲的審理計畫比預期提早結束，法官決定就柯文哲、應曉薇2人的延押訊問以及2人聲請具保停押訊問提前到昨天上午進行，聽取檢辯意見，並提解2人到庭。案經合議庭評議後，今天做出裁定。（編輯：方沛清）1140905 延伸閱讀：快訊》14:57臺南市楠西區發生規模4.1有感地震 最大震度嘉義縣大埔4級標錯價？Twice演唱會期間 高雄漢來一晚「只要520元」 業者回應了北院裁柯文哲7000萬交保 黃國昌「這話」惹議 她酸：你不想要柯交保吧迎戰預算會期！民進黨新住民二代實習培訓 為國會注入「新」戰力針對中國挑戰 日本與澳大利亞舉行「2加2」會談九合一大選挫著等? 民進黨滿意度跌破30% 藍白合超綠5.9個百分點
