高市府嚴正回應質疑 啟動跨局處巡查、嚴查違法絕不寬貸
Newtalk新聞 針對議員質疑美濃農地盜採與馬頭山廢棄物清理案，高雄市政府7日嚴正表示，市府對農地與環境保護一向秉持「嚴查嚴辦、零容忍」的原則，相關局處依法積極處理、同步強化監管，市長陳其邁強調，所有涉及到不法，不分藍綠一律嚴辦到底，行政罰都罰最高300萬，不管新案、舊案要把新型態犯罪瓦解，同樣一批人，買地、背後出錢的人或者集團，一定會給社會一個交代，把不法行為繩之以法。 陳其邁表示，包括連舊案也會清查，同時發現109、110年有會勘，當時對濫挖型態有問題，執法上、規定上都沒有從嚴處罰；面對農地農用國土保安，除了中央修法，在法令執行上，不會讓這事情再重演。並在本會期提出修正營建剩餘土石方管理自治條例，增訂GPS罰責全程追蹤土方流向，並建請中央修正土石採取法增訂刑責。 市府環保局於今年1月接獲舉報馬頭山案地疑有不明機具人員進出，自接獲通報後即與檢警啟動聯合偵辦行動，並依檢察官指示於2月20日發動檢警環聯合偵查行動，同時於現場開挖採樣，並送國家環境研究院認證實驗室以TCLP標準法檢測，確認為一般事業廢棄物。全案於9月1日偵結起訴後，環保局立即依法命7名行為人限期清理，逾期則啟動代履行清除並求償，公有土地部分目前已完成清運，相關程序並無任何延宕情形。 馬頭山案於今年2月檢警環偵辦行動中，已現場採集9件樣品送往國家環境研究院認證第三方實驗室以標準檢驗方法TCLP進行檢測，結果顯示含銅量僅＜0.1至1.57 mg/L，遠低於有害事業廢棄物認定標準15 mg/L，確認屬一般事業廢棄物。而議員使用的XRF儀器(攜帶式X-射線螢光光譜儀)，是作為土壤中元素濃度快速篩選，其測值常為TCLP數值百倍以上，所檢測的物質在環境中並非全數溶出(以不鏽鋼湯匙、硬幣為例，若經XRF檢測其鎳金屬含量也會高得異常)因該方法非屬廢棄物標準檢驗方法，容易誤導民眾造成恐慌，應以TCLP標準檢測方法才正確。 此外，對外界關注的美濃農地盜採與回填案，經發局已啟動「密集地毯式巡查」，副秘書長張家興率領跨局處聯合小組每週巡查美濃、旗山、六龜等盜採熱區，導入無人機偵查與科技執法，加強路口監控與預防性攔查，嚴防坑洞回填廢棄物再度發生，市府同時要求施工單位申報回填土方種類與數量，確保整復過程透明可稽。 針對違法盜採土石行為「嚴查嚴辦！絕不寬貸！」，市府持續與檢警合作，共同查處盜採土石違法；針對坑洞回填整復，要求行為人提出回填計劃送裁處機關審查，並於回填期間，各相關單位須加強派員稽查，確保農地整復完成；取締農業用地堆置土石，將依都市計畫法、區域計畫法嚴正裁罰絕不寬貸。 高雄市對於非法棄置廢棄物採取「零容忍」態度，目前已完成60件場址解列，另有13件清理完成正進入解列審查。所有非法棄置案件均要求行為人自行清理，若拒不配合，將依法移送執行，並代為清除求償，絕不讓全民承擔。 高雄市政府重申，無論是農地盜採、廢棄物棄置或土地違規使用，市府均依法究責、公開透明，並同步強化科技監管、跨局處聯防及社區通報機制，防範不法再生。市府呼籲議員及各界理性監督、回歸事實，共同守護高雄的土地與環境安全。延伸閱讀：黃文益關心第一線執勤員警 籲推「防彈背心隨人制」並增設警用通訊基地台「2025高雄愛．月熱氣球」月世界圓滿落幕 雙十連假愛河浪漫登場「大港經典」決賽倒數！ 3場跨界實戰為11組青年設計團隊熱身談台積電建廠進度 陳其邁：串聯全球最完整半導體生態系 怒斥「邁瑩大峽谷」污名化！邱議瑩：非地主、非盜採者 籲林國成道歉遭藍營影射與美濃盜採砂石案地主有關聯 當事里長擬提告護清白
