打開朝野僵局「先把憲法法庭恢復正常」謝長廷向拒審案大法官喊話
Newtalk新聞 國民黨與民眾黨利用立院人數優勢在立院推動多項爭議法案，總統府與行政院採取「不副署、不公布」作法反制，朝野僵持不下。對此，總統府資政謝長廷強調，要打開僵局「應該先把憲法法庭恢復到正常狀態。」並向長期缺席評議會議導致憲法法庭停擺的三名大法官喊話：「專業知識的法律人，應該善用其法律知識為人民解決困難，協助國家社會解決問題，而不是把法律知識當做不做事、拒絕、推諉或塞責的利器，尤其是領高薪的公職人員。」 謝長廷在臉書發文寫道，上資深媒體人黃暐瀚「下班瀚你聊」節目，主持人詢問：「台灣朝野的僵局如何打開？」他回應：「我認為有共識就打開。」主持人又問：「可能有共識嗎？」他表示：「元旦好像有看到（民眾黨主席）黃國昌寫的一篇文章說要讓台灣向前走云云，我很是高興，因為那應該就是台灣共同的目標或共識，也許對於僵局的責任或如何向前走等問題，可能又互相攻擊卸責，但就思辯邏輯而言，有共同目標就有可能導出合理的答案。」 謝長廷提到，主持人再問：「具體上要如何做？」他回答：「應該先把憲法法庭恢復到正常狀態。」主持人又追問：「對於拒絕出席評議的三位大法官有什麼看法？他指出：「大法官應是法律飽學之士。不需要旁人指三道四，但我一向認為有專業知識的法律人，應該善用其法律知識為人民解決困難，協助國家社會解決問題，而不是把法律知識當做不做事、拒絕、推諉或塞責的利器，尤其是領高薪的公職人員。」 司法院憲法法庭大法官陷入分裂，5名大法官將3名拒審大法官剔出總額後做出「114年憲判字第1號」判決，宣告藍白惡修的《憲法訴訟法》違憲。國民黨立法院黨團鑿到台北地檢署，告發5名大法官涉嫌枉法裁判罪，並提出「114年憲判字第1號判決無效」公決案主張，憲法法庭日前就《憲法訴訟法》所作出的判決，程序嚴重違憲、組成不合法，應由立法院表態予以否定，要求宣告該號憲判自始無效。經表決，藍白以多數60：51將公決案逕付二讀交付協商。 由於《憲法》規定，司法院設大法官15人，由總統提名，經立法院同意任命之。不過大法官陸續退休，目前僅剩8名，不過賴清德總統兩度提名大法官，全遭立院否決。立法院去年三讀通過《憲法訴訟法》，明定憲法法庭判決，應經大法官現有總額三分之二以上參與評議，大法官現有總額過半數同意。參與評議之大法官人數不得低於10人。作成違憲之宣告時，同意違憲宣告之大法官人數不得低於9人。 修法之後，由於3位大法官蔡宗珍、楊惠欽、朱富美長期缺席評議會議，讓憲法法庭停擺，去年12月19日，憲法法庭自救，做出「114年憲判字第1號判決」，《憲法訴訟法》修法立法程序有明顯重大瑕疵，違背憲法正當立法程序，且違反憲法權力分立原則，都牴觸憲法，應自判決公告日起失其效力。但長期缺席評議會議的蔡宗珍、楊惠欽、朱富美認為，僅由5人做出判決違法。目前的憲法法庭組成、做出的判決，是否有其效力、抑或有程序瑕疵，朝野雙方各自堅持己見。延伸閱讀：柯文哲動作頻頻被解讀直指2028 鈕則勳解析 4 大政治盤算柯文哲long stay嘉義市替張啓楷操盤 鄭麗文：藍白一定會協調爆綠派人放話再搞黃國昌 柯文哲嗆：一定焦土政策柯文哲承諾當張啓楷總幹事、要在嘉義Long Stay 總預算卡關 柯文哲：就喬出方法、賴清德那攏這偏執呢
