Newtalk新聞 在文明社會的基本想像中，律師事務所應是正義的最後一道防線，是制度對抗不公的防火牆。但在中國，律師行業雖然被政黨嚴管，但這個角色正還真的徹底顛覆我們的想像。 從近期中國媒體揭露的北京群益律所相關案件，到2026年初引發關注的北京盈科律所相關風波，我們看到的，不只是個別違法事件，而是一種值得警惕的制度性風險正在浮現。 這或許不代表整個行業皆然，卻已足以提出一個關鍵問題：當法律的守護者開始為高風險行為背書，這塊金字招牌，究竟還是保障，還是另一種形式的「信用陷阱」？ 一、群益律所：專業外衣下的「信任運作」 根據外界揭露與媒體報導，北京群益律所相關事件所呈現的，不只是單純的投資糾紛，而是一種建立在信任結構上的操作模式。其關鍵，不在投資項目本身，而在於「身份」如何被轉化為信用工具。 信用的變現機制：民眾信任的，往往不是投資標的，而是律師所代表的專業與權威。當這種象徵被轉化為顯著高於一般市場水準的回報承諾時，法律信用本身便可能被貨幣化，成為吸引資金的重要因素。 專業與不對稱的結合：那些形式完整的法律服務契約，對專業人士而言或許存在風險訊號，但對一般民眾而言，卻足以構成「已經合法、已被保障」的心理認知。 問題不在於專業本身，而在於當專業缺乏外部檢驗與有效監督時，極易被轉化為誤導工具。這類行為的特殊性在於：它並非單純提供錯誤資訊，而是建立在「對法律體系的信任」之上運作。 二、盈科事件：規模擴張與制度邊界 另一個引發關注的，是涉及中國大型律所的相關爭議事件。作為以規模與網絡著稱的律師事務所，其負責人涉入融資與擔保問題的傳聞與報導，引發外界對律所角色定位的重新思考。 法律服務與資本運作的模糊地帶：當律所不再僅限於提供法律服務，而逐漸涉入資金安排、擔保或其他類金融操作時，其角色可能從「制度中介」轉為「利益參與者」。若缺乏清晰規範與監管邊界，相關風險將被放大。 「個人行為」與制度條件：將事件界定為「個人行為」，在法律上或許成立；然而，若組織結構允許個人動用品牌、名義與資源進行大規模操作，卻缺乏有效制衡，那麼這種「個人行為」，某種程度上亦反映了制度風險的存在。 問題不在於是否存在違規個體，而在於：制度是否提供了足以累積與放大風險的空間。 三、一個更深層的矛盾：當「黨管一切」遇上法律風險 中國的治理邏輯長期強調「黨領導一切」，包括政治、經濟，乃至法律體系與法律專業本身。 理論上，當法律、律師與制度運作皆納入高度集中與垂直管理之下，風險應該被壓縮，而不是擴大。然而，當上述案件仍然發生時，便出現一個值得深思的結構性矛盾：如果監管是全面且有效的，這類風險為何能長期累積？如果法律專業已被納入嚴密管理，為何仍可能被轉化為風險工具？ 這並非單一個體的問題，而是揭示一種更深層的張力：當權力高度集中，但監督與問責未能對等強化時，制度反而可能同時具備「高控制」與「高風險」的雙重特性。 四、誰在承擔這場「信用風險」？ 這些事件或許不能代表整體行業，但仍揭示出幾個值得關注的結構性問題： 監管機制的灰色空間 若律所的資金運作、公章使用與負責人行為長期處於模糊監管地帶，風險可能在未被察覺的情況下逐步累積。 專業倫理與制度約束的落差 當專業角色缺乏對應的透明度與問責機制時，個別偏差行為可能透過制度放大，進而影響整體信任基礎。 法治信任的侵蝕效應 對受影響者而言，損失的是財務；對社會而言，更深層的影響在於信任的流失——當法律專業被視為潛在風險來源之一，制度的穩定性將受到長期挑戰。 結語：當信任成為風險的一部分 這些案件與爭議，不只是個別事件，更像是制度在壓力下顯現的徵兆。它們提醒我們：當制度缺乏透明與制衡，專業本身可能被轉化為風險的載體。 法律或許仍能透過調查與審判回應問題，但被侵蝕的信任，往往需要更長時間修復。如果律師執照不再自動等同於信用保障，如果律師事務所的名號開始被審慎甚至懷疑地看待， 那麼真正需要面對的，將不只是個案責任，而是整個制度如何重新建立其可被信任的基礎。否則，象徵正義的工具，將不再只是防衛風險的屏障，也可能在無形之中，成為風險的一部分。延伸閱讀：首度表態！蔡其昌嗆李貞秀：雙重國籍不能當立委「可以無視法律硬上？」「給你5000歐元縱火要不要？」 …
